This agreement legally binds Customer and MST Dumpsters to the conditions listed below. MST agrees to provide Customer with non-hazardous solid waste collection, transportation and disposal services. Customer agrees to pay for these services. By accepting delivery of the dumpster, Customer acknowledges that Customer agrees to these terms.
The price for each dumpster includes a certain amount of included tonnage. Customer understands that MST cannot predetermine how much weight will be put into the dumpster by the Customer and Customer understands that the dumpster will hold more than the included tonnage.
Customer agrees that Customer will pay for all tonnage in excess of the included amount on a prorata basis. Customer agrees to accept the weigh ticket from the dump site as the actual weight of the debris in the dumpster.
Customer agrees that MST can charge customer’s credit card on file for any excess tonnage amounts. MST represents that the dump sites are not affiliated with MST and that MST is obligated to pay the dump site the actual amount reflected on the weigh ticket.
Customer agrees to give MST notice for any requested service (delivery, exchange, pick up or relocation). If a request for service is received after 10am, MST cannot guarantee service for the next business day.
There may be times when a delay could be incurred in servicing your needs due to inclement weather, traffic conditions, equipment problems, etc. WE DO NOT GUARANTEE SPECIFIC TIMES FOR A DUMPSTER DELIVERY OR PICK UP. Same day service and cancellations will be charged a fee.
It is the Customer’s responsibility to give MST clear instructions as to where they want the dumpster placed. MST always asks for placement instructions when the order is taken. If MST follows the instructions given and the customer needs the dumpster moved for any reason other than MST not following the instructions, the Customer will be charged a minimum of $125 to move the dumpster. The exact amount is determined by the particular circumstances.
If MST attempts to deliver or pick up a dumpster and the dumpster is blocked or a gate is locked or MST is prevented from delivering or picking up a dumpster, the Customer will be charged a $250 No Service fee. This fee may also be charged if MST elects to wait on site for the problem to be resolved.
Customer agrees not to put any hazardous or toxic waste in the dumpster. All hazardous or toxic waste in the dumpster remains the responsibility of the Customer.
At MST’s discretion, MST may return the hazardous or toxic waste found in the dumpster and charge the Customer a $250 return fee, or MST may choose to charge Customer a disposal fee for the hazardous or toxic waste found in the dumpster as detailed below.
Hazardous or toxic waste includes industrial waste, asbestos, paint, cleaning solutions, biomedical waste, pesticides, solvents, automobile parts, tires, oil, oil filters, oil containers, gas cans, propane tanks, batteries, appliances with Freon, Freon aerosol cans, foam aerosol cans, electronics, ballasts with PCB’s, devices containing mercury, light bulbs, telephone poles, railroad ties, household garbage and other like items.
At MST’s discretion, MST may charge Customer, and Customer agrees to pay, a disposal fee for the hazardous or toxic waste found in the dumpster. Those fees will range from $50 to $200 per item, depending on the item.
All equipment furnished by MST shall remain the property of MST, however Customer shall have care, custody, and control of the equipment and shall bear responsibility and liability for all loss or damage to the equipment and its contents while at Customer’s location, including costs to repair the dumpster if damaged while in the possession, custody or control of the Customer.
If Customer puts material including, but not limited to, wet concrete, paint, and tar, which adheres to or damages the dumpster, Customer shall be responsible for all costs incurred in removing the substance and restoring the dumpster.
Customer shall not move or alter the equipment and shall use the equipment only for its intended purpose. Customer shall provide unobstructed access to the equipment on the scheduled pick-up day. MST specifically prohibits Customer from using a third party mobile waste compaction service to compact the waste in MST’s dumpsters.
Those services potentially cause damage to the dumpster and can compact the waste to the point it cannot be dumped out of the dumpster in the normal course of dumping. If Customer does use one of those services, MST will charge Customer $300 for violation of this agreement.
MST is NOT responsible for damage to Customer’s property, Customer’s customer’s property or property of any third parties, including, but not limited to, grass, walkways, curbing, pavement, driveways, pavers, irrigation, wells, septic or underground utilities resulting from MST’s provision of services. Customer warrants that the right of way and placement spot are sufficient to bear the weight and physical dimensions of MST’s equipment and vehicles.
If Customer insists on putting the dumpster closer than two feet to a building or other structure, Customer agrees to hold MST harmless for any damage incurred.
Customer agrees not to overfill dumpsters beyond the top rail and not to overload the dumpster by loading more than 15 tons of debris. If the dumpster is overfilled or overloaded, MST may choose to either refuse to pick up the dumpster or may pick it up despite it being overfilled or overloaded.
If MST refuses to pick it up, Customer will be responsible for off-loading the dumpster to an acceptable level and/or weight. Additionally, all debris must be cut into pieces no larger than 4 ft.
A $1000 fee will be applied for all overfilled or overloaded dumpsters, whether or not MST chooses to pick up the dumpster or require the customer to off-load it. Additionally, if the dumpster or the truck is damaged due to it being overloaded, customer will be responsible for the cost to repair the dumpster or truck.
Heavy debris, such as concrete, dirt, roof tiles, asphalt, floor tile, etc., can only be put in 10 and 20 yd dumpsters.
A daily rental fee will apply after the included number of days if the dumpster is not emptied & returned or removed at the Customer’s request. MST Dumpsters reserves the right to charge the credit card on file for excess days prior to dumpster removal. If the dumpster is emptied & returned, the next dumpster is considered a new rental and includes the same number of days as the first dumpster.
Customer agrees to indemnify, defend, and save MST harmless from and against any and all liability which MST may be responsible for or pay out as a result of bodily injuries (including death), property damage or any violation or alleged violation of the law to the extent caused by Customer’s breach of this Agreement or by any negligent omission or willful misconduct of the Customer or its employees, agents, or contractors in the performance of this agreement.
Neither party shall be liable to the other for consequential, incidental, or punitive damages arising out of or in connection with the performance or non-performance of this agreement.
Any amounts not paid within 15 days of the date of the invoice, shall incur a $50 late fee and accrue interest at the highest rate allowed by law. If collection proceedings are initiated, the prevailing party shall be entitled to collect all attorney’s fees and costs, including those incurred for any appeal. If a credit card is declined, MST shall charge a $50 re-processing fee. MST reserves the right to charge a 3.5% surcharges for any credit card transactions.
